A. DEFINITIONS AND INTERPRETATION

In this Agreement for Apna Shahar, certain terms are defined as follows:

(a) “App” refers to the Android mobile platform owned by Apna Shahar, operated under the developer name “Apna Shahar,” which includes any subsequent updates.

(b) “Platform” encompasses all properties under ” ASPIA Infotech,” including, but not limited to, the Android mobile apps operating under the developer name “Apna Shahar” and websites under the domain name “apnashahar.app.”

(c) “User” or “You” or “Your” denotes a natural person who has accepted this Agreement to download and utilize the Apna Shahar app.

Throughout this Agreement, singular terms include their plural forms, and vice versa, as well as references to one gender encompassing other gender(s).

Headings and captions within this Agreement are provided for convenience purposes only and do not influence the interpretation of the Agreement.

References to natural persons include their heirs, executors, and permitted assignees. Similarly, references to juristic persons include their affiliates, successors, and permitted assignees, unless the context indicates otherwise.

B. YOUR APPROVAL

1. You approve of and accept this Agreement by:

(a) downloading and/or installing the App on Your device; or

(b) accessing or using the App or any of the content available within the App from any device.

2. You can accept this Agreement only if:

(a) You must be of legal age, eligibility, and mental capacity to form a binding contract with Apna Shahar through your use of the app; and

(b) You must not be legally prohibited from using the Apna Shahar app.

3. You understand that We want You to not use the App if You do not understand, approve of or accept all the terms specified in this Agreement. Hence, You are requested to read these Terms and Privacy Policy (hyperlinked) carefully and understand the Agreement before You accept it and agree to be bound by it.

C. PROVISION OF THE APP

Apna Shahar is designed to offer you an in-app browsing experience through an embedded browser.
The app may contain links to other mobile applications and/or websites, some of which may display objectionable, unlawful, or inaccurate content. These links are provided for your convenience only, and we do not endorse or support the products and services they offer. We are not liable for the content or accuracy of such links.
In order to provide you with the best experience, we may ask you to register and provide information about yourself. We expect that any information you provide will be truthful, accurate, complete, and up-to-date.
The content displayed on Apna Shahar is intended for your personal, non-commercial use. You are not permitted to copy, reproduce, alter, modify, create derivative works of, or publicly display any content from the app.

D. YOUR AGREEMENT WITH APNA SHAHAR

Any violation of this Agreement may result in legal liability for you, and nothing in this Agreement should be interpreted to confer any rights to any third party. You are accountable for your conduct and activities while using the Apna Shahar app, and for any consequences that may arise from them.
If any provision of this Agreement is deemed unenforceable under applicable law, it will not affect the enforceability of the remaining provisions. In such cases, the invalid or unenforceable provision shall be replaced by a valid and enforceable provision that closely aligns with the original intent, while the remaining provisions shall remain in effect.
While we may choose not to take action regarding a breach of this Agreement by you or others, this does not waive our right to act in response to subsequent or similar breaches. Our failure to enforce any provision of this Agreement does not constitute a waiver of such provision or our right to enforce it in the future.

E. USING THE APP

You agree to download and install the Apna Shahar app for your use. Additionally, you agree to download and update the latest versions of the app and any relevant updates provided by us to ensure continued access.
While the app is currently available to you free of charge, we reserve the right to amend these Terms and potentially introduce charges for the app in the future. While we do not guarantee prior notice, we will endeavor to inform you in advance of any such changes.
Your use of the app must comply with (a) this Agreement, and (b) any applicable laws, regulations, or generally accepted practices and guidelines in your country of citizenship, residence, or usage.
Under this Agreement, Apna Shahar grants you a limited, non-exclusive, non-transferable right to install and use the app on your Android device. However, you are not permitted to copy the app or any of its components, except for the purpose of creating a single archival backup copy.
Apna Shahar also grants you a non-exclusive, non-transferable license to access content owned by Apna Shahar. However, for any third-party content accessed through the app, you must obtain a separate license from the respective third party. We do not provide a license for such third-party content, and your usage is subject to the terms and conditions set forth by the third party.

F. RESTRICTIONS ON YOUR USE

You agree not to utilize the Apna Shahar app or any content provided therein for any illegal, unlawful, or prohibited purposes as outlined in this Agreement.
You will refrain from accessing the content provided through the app via any means other than the app itself, unless explicitly permitted in a separate written agreement with Apna Shahar.
Redistribution, sublicensing, renting, publishing, selling, assigning, leasing, marketing, transferring, or otherwise making the app or any of its components or content available to third parties is strictly prohibited.
You are prohibited from circumventing or disabling any digital rights management, usage rules, or security features of the app; altering or obscuring any proprietary notices (including copyright notices) on the app; and using the app in a manner that threatens its integrity, performance, or availability.
You shall not engage in any activity that may:

(a) Reverse engineer, decompile, or extract the source code related to the app, unless expressly permitted in writing by Apna Shahar or required by law; (b) Use any automated device to retrieve or index any portion of the app or its content; (c) Collect user information for illegal or unlawful purposes; (d) Create user accounts by automated means or under false pretenses; (e) Transmit viruses or other harmful items through the app; (f) Damage, disable, overburden, or impair any servers, networks, or computer systems connected to the app; (g) Conduct harmful attacks or disrupt the app’s functionality; (h) Forge headers or manipulate identifiers to disguise content origin; (i) Obtain materials or information through unauthorized means.

You shall not impersonate any person or entity, including Apna Shahar officials, employees, partners, or affiliates, or misrepresent your affiliation with any entity.

G. TERMINATION

Your access to the Apna Shahar app may be terminated under the following circumstances:

(a) If you voluntarily uninstall the app from your device; (b) If, knowingly or unknowingly, you cause a direct or indirect breach of these Terms or Privacy Policy, as determined by Apna Shahar; (c) If you fail to pay any requisite fees, if applicable, charged by Apna Shahar for app usage.

Apna Shahar may terminate your access to the app if:

(a) Required by law, making the provision of the app unlawful; (b) Our relationship with any third party offering the app is terminated, or their services are no longer available to us or to you; (c) Provision of the app to you is no longer commercially viable for Apna Shahar; (d) You repeatedly violate this Agreement.

Apna Shahar reserves the right to terminate this Agreement at any time, with or without notice, and may disable your access to the app and prohibit any future use.
You may terminate this Agreement at any time by discontinuing your access to the app. However, certain obligations under this Agreement will continue even after termination.
Upon termination of this Agreement, any legal rights, obligations, and liabilities accrued during its term will remain unaffected and continue to apply indefinitely.

H. THE INFORMATION WE COLLECT AND HOW WE USE IT

At Apna Shahar, we collect various types of information from you to enhance your experience on our platform. Here’s how we use the information we collect:

Obligation Adherence: It’s your responsibility to adhere to the terms of the Agreement. Any breach of your obligations may result in consequences for which you are accountable.

L. NO WARRANTIES

At Apna Shahar, we prioritize transparency and honesty regarding the functionality of our App:

Disclaimer of Warranties: While we strive to provide the best possible user experience, we cannot guarantee certain outcomes. We disclaim all warranties, whether express or implied, including:

(a) Constant availability or availability at all times.

(b) Successful execution of installation or uninstallation choices.

(c) Seamless functioning of the App without disruptions, delays, or errors.

(d) Personal ability to use the App.

(e) Satisfaction with the App’s use.

(f) Accuracy of the data provided.

(g) Security and privacy of Your data.

(h) Correction of all bugs or errors.

(i) Compatibility with all devices and networks.

(j) Fitness for a particular purpose or use.

(k) Accessibility of the App and its contents in every location.
Limitation of Liability: Apna Shahar, its officers, directors, employees, affiliates, agents, and service providers are not liable for acts or omissions of third parties, including vendors participating in Apna Shahar’s offerings. We are also not liable for any damages associated with equipment not furnished by Apna Shahar or services provided by third parties interconnected with Apna Shahar.

M. GOVERNING LAW AND DISPUTE RESOLUTION

Ensuring legal clarity and fair dispute resolution is essential at Apna Shahar:

Applicability of Local Laws: The App may operate under the laws of various countries. If you use the App from any location, you are responsible for complying with the local laws applicable to you.
Governing Law: This Agreement is governed by and construed in accordance with the laws of India. Any disputes arising from this Agreement shall be settled in the courts located at Bangalore, India.
Time Limit for Action: Both you and Apna Shahar agree that any legal action arising from your use of the App must be initiated within 3 (three) months after the cause of action accrues.

N. NOTICES

1. Apna Shahar may post notices within the App or send you notices on the e-mail address or the telephone number that You may have shared with Us. You will have received such notices within 3 (three) days of Us sending the notice. Your continued use of the App on expiry of such 3 (three) days shall constitute Your receipt and acceptance of the notices sent to You.

O. DISCLAIMER

At Apna Shahar, we want to ensure transparency and provide clarity regarding the use of our platform:

Accuracy and Changes: While we strive for accuracy, there may be technical inaccuracies or typographical errors in the content provided through the App. Apna Shahar reserves the right to make changes or improvements to the App at any time. The content and information available on the App are provided “as is” and “as available,” without warranties of any kind, expressed or implied. Apna Shahar does not guarantee uninterrupted or error-free functions, correction of defects, or virus-free servers. Apna Shahar makes no commitment to update the materials on the interface. However, applicable law may override these exclusions. Apna Shahar shall not be liable for any misuse or data theft resulting from your use of the App.
Disclaimer of Warranties: The App, and all news contents accessed through the App, are provided “as is,” “as available,” and “with all faults.”
User Representation and Warranty: By using the App, you expressly represent and warrant that you understand, agree to become a party to, and abide by all the terms specified in this Agreement. Any violation of this Agreement may result in legal liability upon you. This Agreement does not confer any rights to any third party or any other person.
